INTERPRETATION

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

• Service: Refers to the entire suite of services provided by the Company, including but not limited to the loan application portal, underwriting services, and the facilitation of connections between Borrowers and Investors.

• Service Provider: Any natural or legal person who processes data on behalf of the Company. This includes third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used.

• Usage Data: Data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

• Website: Refers to Capitismic.com, accessible from https://capitismic.com.

• You: Means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

• Investor Information: Data required to qualify You as an Investor, which may include information related to your accreditation status and other financial details.

USAGE DATA

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g., IP address), which we collect for security and rate-limiting purposes, browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

SMS MESSAGING & COMPLIANCE

Text Message Program Terms & Conditions - By opting into our SMS messaging services, you agree to receive text messages related to our services, including appointment reminders, customer support, and important updates.

• For Marketing and Promotion: to provide You with news, special offers, and general information about other goods, services, and events which we offer that are similar to those that you have already enquired about, unless You have opted not to receive such information. (We do not sell, rent, or trade your mobile phone number or SMS consent to third parties for their marketing purposes).

• To manage Your requests: to attend and manage Your requests to Us.

• For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, or other sale or transfer of some or all of Our assets, in which Personal Data held by Us about our Service users is among the assets transferred.

(Note: In such cases, your text messaging opt-in data remains protected under the terms of this policy).

SMS DATA PROTECTION STATEMENT (STRICT NON-SHARING POLICY) Notwithstanding any other provision in this policy, the following applies to your mobile information:

No mobile information will be shared with third parties/affiliates for marketing and/or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

RIGHT TO ACCESS AND CORRECT

You have the right to request access to the personal information we hold about you and to challenge the accuracy and completeness of that information. Upon request, we will provide you with a copy of your personal information and will correct any inaccuracies.
